Kilmar Abrego Garcia, an illegal MS-13 gangbanger from El Salvador with a lengthy wrap sheet prompted an immigration judge to order his removal in 2019. Garcia stayed and continued his criminal MS-13 rampage.
Now he's somehow landed in the cross hairs of a national debate.
How do we get millions of dangerous criminals like Garcia outta here? Do all terrorists self-qualify for the asylum loophole?
Trump's enacting the same Expedited Removal Process (ERP) within our immigration law used for nearly 30 years.
The ERP hinges on deporting dangerous illegals w/o engaging an immigration judge. Every President since Clinton has used it to quickly deport millions of dangerous illegals.
Each has tailored the ERP to their liking, including Trump. Obama deported 2.7M, Bush 2M. But somehow, orange man bad.
No President has faced undoing a tsunami of 20 million illegals purposefully and aggressively en massed into our nation over the past four years like Trump's stuck doing.
The Left wants, craves, demands these illegals stay, no matter what the cost to life, property or treasure. It's sick beyond comprehension. But it is what it is.
Now activist judges demand 'due process' forcing each illegal, dangerous or not, to stand before an immigration judge, essentially nullifying the ERP.
But that's the whole point of the ERP, to bypass this requirement for the dangerous just as every President has successfully done since Clinton.
Given the 20 million illegals, Trump has expanded the ERP scope, pushing the hyperventilating Left to expand their lawfare largess marshaling Congress, States and anyone else who wants to get a piece of the action as Representative Laura Friedman recently detailed.
Keep in mind, the full breadth of immigration law, including to use of immigration judges within the deportation process, is still fully utilized for those falling outside Trump's definitions for ERP candidates.
So why? Why has Garcia become the Left's latest symbol of sudden social justice? It's like Michael Brown 'hands up don't shoot' hoax all over again. Why does the Left continue to select one person to anoint as the ambassador of all things good, no matter how much the actual facts dispute the label?
The massive use of universal injunctions (UIs) by district judges makes no sense either. As Senator Kennedy outlined, UIs are not supported by the Constitution, SCOTUS, Statute or Common Law.
So how are UIs even legal? Yet the avalanche of UIs against Trump stand. Newt Gingrich's Senate testimony likens this to essentially a “judicial coup d'etat”.
If the fever doesn't break, next step per Article I, Section 9 could be the suspension of habeas corpus, heaven forbid, to bypass the weaponized judicial. No one wants to go there, but what else do we do?
Sit back and let the terrorists continue to eat us alive? I certainly don't want a repeat of 2020's 'summer of love' riots in a few months either.
In short, I support President Trump, Senators Barrasso/Lummis and Representative Hageman on this one. Legal immigration GOOD. Illegal, BAD.
