counties on Thursday that a 4% cap on yearly increases in residential property taxes is unconstitutional, and the counties shouldn’t let taxpayers have that exemption.

The State Equalization Board will refuse to certify this year’s property tax assessment figures if counties keep that cap on them, the report says.

The board’s two-person majority — Chair Jayne Mockler and Vice-Chair Marty Hardscog — wrote in the Thursday report that the 4% increase cap for residential property taxes has arbitrary impacts across the state. 

It also disproportionately insulates high-end homes, and disfavors homeowners in more sluggish market areas, the report asserts.

But the report’s main point, and conclusion from the past two years’ tax data, is that the 4% cap violates the Wyoming Constitution’s call for equal and uniform property taxes within each class of property.

The board hasn’t yet issued an order requiring Wyoming’s county assessors to rework their pending tax bills without the cap.

But it expects to do so in the coming weeks after working with counties, Mockler told Cowboy State Daily in a Thursday phone interview.

“We issued this report today that says if that cap doesn’t come off, Marty and I can’t vote to certify residential property taxes. Because they’re not uniform,” said Mockler. “It’ll be followed with an order ... (and) our goal is ultimately to remove the cap.”  

Mockler noted that the board isn’t targeting the other, narrower exemptions with this report — like the 25% property tax cut passed in 2025 or the long-term homeowner exemption.

More than half of the state’s residential property tax values fall under the 4% increase cap, the report says.

This kind of push from the state board is unprecedented, Converse County Assessor Dixie Huxtable told Cowboy State Daily on Thursday.

But Wyomingites shouldn’t expect a tax-free year over the maneuver, she said.

“Everyone’s in agreement there will be residential property taxes for 2026,” she said. “This … is just a step in the process of getting different values the board feels is appropriate.”

The pending mandate leaves Wyoming counties somewhere between following the 4% cap requirement in state law and following another state law that tells assessors to obey the state board, she said.  

“You’re asking us to go against the law? Under the law we have to apply the 4% cap and you’re saying we can’t,” she reflected from the report.

She said she was digesting the report Thursday afternoon, and had just been to a phone meeting with the board officials, assessors, and county attorneys.

Two days earlier on Tuesday, Huxtable had just urged the Legislature’s Joint Revenue Committee to approach more changes to the state’s property tax law with caution, because assessors are always trying to keep up with the many changes lawmakers have brought in recent years.

Assessors are at the mercy of state law and are working hard to follow it, she’d said.  

Reflecting on the board’s Thursday report, Huxtable told Cowboy State Daily that assessors are now trying to gain clarification on what to do in the coming weeks.

“We’re on standby,” she said, adding that from her meeting with the board, her impression is, “They’d be tickled pink to go to court” on this issue.

Wyoming Attorney General Keith Kautz said Thursday that he doesn’t know of any litigation on this currently, “but if there is a challenge, we will support what the Legislature did.”

Rep. Barry Crago, R-Buffalo, who has since become a state senator, was the sponsor on the main bill the board’s Thursday report derides as unconstitutional.

Crago did not return a Thursday afternoon voicemail request for comment by publication.

The board’s report points to inconsistencies across the Wyoming property tax structure.

People who upgrade their homes by changing the footprint of those homes lose the cap exemption to a reset that year, while people who upgrade only the interior do not, says the report.

It says some homes have had their tax bills so thoroughly capped, they’re paying less than half of the state-mandated property tax rate.

“The demarcation between taxpayers receiving a tax windfall, versus those who do not, serves no rational basis,” the document adds.

Rep. Liz Storer, D-Jackson, told Cowboy State Daily on Thursday that she had voted for the 4% tax cap during the tax hikes of 2024. But she views the law as more of a short-term fix. 

"It was a tourniquet; it was a short-term fix," she said. "Butif you leave the tourniquet on, you damage the body." 

Storer's home region of Teton County accounts for huge property tax revenues in Wyoming. She has tried over the years to get lawmakers to stop applying property tax breaks to people's secondary homes. 

Of the $860.2 million in exemptions the 4% cap is expected to cause this year, Teton County accounts for $507.9 million, says a Department of Revenue memo Storer sent to Cowboy State Daily.

The board warned lawmakers before the 4% cap bill’s passage that board members believed it’s unconstitutional.

The board examined the residential assessment values and looked for inverted valuations, that is where higher-valued properties were assessed at lower taxable values than other, similarly situated properties.

The board during the 2025 tax calculation process had just two members, Mockler and Hardscog. They voted that year to certify the tax values, but said that those values were probably invalid. Still, they wanted to gather one more year of data to be sure, the report says.

They also planned to release a Nov. 13, 2025, order requiring assessors to stop giving the exemption.

Gov. Mark Gordon’s office asked the board not to issue that order, the report says.

In November and early December, the governor’s office and Wyoming Attorney General’s Office met with Hardscog and Mockler to talk about filing an action asking a court to judge the issue.

The governor’s office and AG’s office agreed the state board should file that court action, the report says.

The litigation was slated to be filed Jan. 20. Gordon’s office asked for multiple delays, at first to communicate the lawsuit with legislative leaders. 

When Gordon’s office asked for another delay two days later, Hardscog and Mockler said they wouldn’t certify the property tax values after the June tax calculation process, “without a working resolution of their constitutional concerns,” says the report.

The Clinton-era Roadless Rule on U.S. Forest Service lands, already under threat of being rescinded by the Trump administration, will be erased completely if Wyoming Republicans U.S. Sen. John Barrasso and Rep. Harriet Hageman get their way.

Sen. Mike Lee, R-Utah, has attached an amendment to Barrasso’s Wildfire Prevention Act of 2026, calling for the Roadless Rule to be nullified.

The Senate Committee on Energy and Natural Resources on Wednesday passed Lee's amendment and forwarded the bill.

On the U.S. House side in May, Hageman introduced her Roadless Rule Nullification Bill.

Both Hageman’s bill and Lee’s amendment call for the 2001 U.S. Forest Service Roadless Rule to be nullified, with no possibility of it ever being reintroduced.

The Roadless Rule has forbidden new road construction on national forests across Wyoming’s high country. It’s also similarly prevented new road construction on 45 million acres of national forest lands across the West, and up to 60 million acres nationwide.

In August 2025, U.S. Secretary of Agriculture Brooke Rollins and U.S. Forest Service Chief Tom Schultz announced the first step toward rescinding the rule, as directed by the Trump administration.

A decision is still pending on Trump’s call to repeal the rule.

Hageman and others who support eliminating the Roadless Rule argue that the rule has hampered sound forest management and wildfire prevention.

Environmentalists and sportsmen’s groups balk at the idea of erasing the Roadless Rule. They claim it protects some of Wyoming’s most pristine areas, with top-notch hunting and angling opportunities.

Congressional moves against the Roadless Rule complement and bolster the Trump administration’s efforts to rescind it, according to Hageman and Barrasso.

“I have been fighting the Roadless Rule since the day it was handed down in the final 10 days of the Clinton administration,” Hageman said in a Thursday statement to Cowboy State Daily.

“The 25 years since have demonstrated how the prohibitions on roads across nearly 60 million acres of federal lands has been an environmental catastrophe as predicted,” she said. "I am glad to see the Senate take positive steps towards this devastating rule’s permanent repeal.”

Barrasso shares Hageman’s concerns about the impact the rule has had over the past 25 years.

“Senator Barrasso has been publicly opposed to the Clinton Roadless Rule for decades. He applauded Secretary Rollins and the Trump administration for rescinding this rule last year,” according to a statement from Barrasso’s office Thursday to Cowboy State Daily.

“This amendment would codify the administration’s efforts to rescind this outdated rule, while also respecting states’ rights to create their own rules,” the statement says.

The Roadless Rule has long been controversial. In June 2025, Hageman blasted it, saying it leaves Wyoming more 

Vast roadless areas prevent the removal of swaths of dead timber and other wildfire fuel, Hageman said. And a lack of roads makes it difficult for firefighting crews to reach remote areas when blazes break out.

However, some sportsmen’s and outdoor groups claim the Roadless Rule protects some of Wyoming’s greatest outdoor treasures.

"Repealing the Roadless Rule would affect 45 million acres of our country’s National Forests,” said the Outdoor Alliance. "These are the places we ride, hike, bike, ski, and climb, and they help protect clean air and water across the country.”

The Outdoor Alliance disagrees with Hageman and Barrasso, saying that “roadless areas also allow for active management of wildfire.”

The Wilderness Society goes further, calling the legislation “bad news” in a Wednesday statement.

“A new bill introduced by Senator John Barrasso (WY) and backed by Senator Mike Lee (UT) would strike down protections for 45 million acres of national forests by nullifying the Roadless Area Conservation Rule,” the group says in a statement. 

The bill “masquerades as a solution to the wildfire crisis, but would make matters worse by overthinning naturally resilient forests and increasing the risk of human ignitions when wildland firefighting forces are already stretched thin by the administration’s reckless cuts,” the Wilderness Society says.

Roadless areas are vital to Western hunting and angling, Devin O’Dea, the Western policy and conservation manager for Backcountry Hunters and Anglers, previously told Cowboy State Daily. 

“These are places we know are really valuable from a hunting and fishing perspective,” he said. 

Retired U.S. Fish and Wildlife Service grizzly bear biologist Chris Servheen is a vocal supporter of the Roadless Rule.

In a move indicating that concerns over the dwindling Colorado River have reached a new level, Wyoming Gov. Mark Gordon and U.S. Sens. John Barrasso and Cynthia Lummis joined other Western elected officials met for discussion and negotiations in Washington, D.C.

Gordon, Barrasso and Lummis met Tuesday with Utah Gov. Spencer Cox Chairman of the Senate Energy and Natural Resources Committee Mike Lee, R-Utah, Sen. John Curtis R-Utah.

On Wednesday, Barrasso invited Pinedale rancher Mike Vickrey to testify about the Colorado River negotiations before the Senate Energy and Natural Resources Committee.

 said that in Wyoming and other Upper Colorado River Basin states, “our expectations of how much water we will have to irrigate with are based on Mother Nature,” according to a statement from Barrasso’s office.

Vickrey told the Senate committee that as he sees it, he and other Upper Basin farmers and ranchers have gone above and beyond to conserve water.

Meanwhile, downstream states benefit from greater “security” offered by large reservoirs at Lake Powell and Lake Mead, 

Parts of two of Wyoming’s reservoirs along the Green River, a major tributary of the Colorado River, are in Sweetwater County. Those include Fontenelle Reservoir and Flaming Gorge Reservoir.

That means the area has a huge stake in what happens along the Colorado River, Sweetwater County Commissioner Taylor Jones told Cowboy State Daily on Wednesday.

“I think our concerns are the water levels, and our lack of say,” in Colorado River policy, he said.

Officials offered few details of what the D.C. meetings might mean going forward for Wyoming and the other Upper Basin states of Colorado, Utah and New Mexico.

Barrasso is “taking the lead” in the matter, according to a text message from Gordon’s office to Cowboy State Daily.

“Any management plan must address shortages from emergency withdrawals and drought, especially from Wyoming’s Flaming Gorge Reservoir,” Barrasso said in a statement following Tuesday’s meeting. "Wyoming and Utah will continue to fight for a seven-basin-state solution that treats our Upper Basin fairly,” 

More details should be forthcoming, Barrasso’s Communications Director Laura Mengelkamp told Cowboy State Daily on Wednesday.

“This week’s meeting was a great first step in developing an agreement that will treat the upper basin states fairly. The governors and senators did discuss several possible solutions and we will have more to say on that in the future,” she stated.

Wyoming State Engineer Brandon Gebhart represents Wyoming on the Upper Colorado River Commission. 

In an email response to questions from Cowboy State Daily on Wednesday, he said that he had no comments beyond what Gordon had already stated.

In a Tuesday statement, Gordon said the discussion between the Upper Basin elected officials had been “productive.”

“Wyoming is committed to bringing forward ideas, and leading the search for practical solutions that recognize both the realities of drought and the needs of the West,” Gordon stated.

Tension has been brewing between the Upper Basin states and those in the Lower Basin, namely Nevada, California and Arizona.

All seven Colorado pact states, as well as numerous Native American tribes and Mexico, were allocated water rights from the Colorado River and its major tributaries under the 1922 Colorado River Compact, which remains binding.

Many experts say there’s far less water in the river now than there was in 1922, but demand has grown with the population.

The Upper Basin states say that most of the population growth has been in the Lower Basin, which continues to demand more water.

Water from the Upper Basin, including the Green River in Wyoming, feeds the Lower Basin’s two primary reservoirs, Lake Powell and Lake Mead.

It was announced this spring that roughly 1 million acre feet of water would be drawn from Flaming Gorge Reservoir to make up for a shortfall in Lake Powell.

Tony Valdez, owner of the Buckboard Marina on the Wyoming side of Flaming Gorge, previously told Cowboy State Daily that the drawdown could be

Jones said the reservoirs and marinas are vitally important for Sweetwater County.

“When they’re going draw the water down, it’s going to affect fishing, it’s going to affect tourism,” he said. "It’s going to affect the marinas, on both the Wyoming and Utah sides of Flaming Gorge.”

“The marinas, they’re even talking about going out of business,” he added.

The county commission hopes to meet soon with Gordon and other state officials. So far, there have been few details coming from state offices, Jones said.

“It’s been pretty quiet, which is a little frustrating,” he said.

 also said policy should be based upon how much water is actually available.

“The only way going forward is a shared pain as hydrology worsens,” Vickrey said. "From my Upper Basin perspective, a supply-driven model of the river is imperative. 

"As conditions continue to change, we must adapt to the actual amount of available water and continue to search for new sources of usable water."

The future hinges on continued negotiations, Jen Lamb, Wyoming representative for the Nature Conservancy, told Cowboy State Daily.

“I think Wyoming remains focused on trying to stay solution oriented, and the fact that the states are still at the table is really critical,” she said.

Three of the Republicans hoping to become Wyoming’s next governor answered questions at a Tuesday forum in Cheyenne that were tailored to, and delivered in front of, a largely Christian audience.

Wyoming Family Alliance, an advocacy group that emphasizes Biblical principles and Christian ideals, also hosted U.S. House and U.S. Senate candidates at the forum.

State Superintendent of Public Instruction Megan Degenfelder, retired Marine Col. Brent Bien, and former state House Speaker and current Sen. Eric Barlow took the stage in the packed Metropolitan in downtown Cheyenne.

Wyoming Family Alliance president Nathan Winters posed questions about parental rights and autonomy, the role of faith in governance, education, abortion and religious freedom.

The governor’s candidates displayed minor policy and philosophical differences - yet greater disparities in tone.

Bien spoke in bold tones, pulled from his past experiences in active duty in Baghdad and elsewhere, and called for Wyomingites and every level of government to wage war on evil and usher in a revival of good.

Degenfelder, assertive in tone, pointed to what she cast as her own strong Christian faith, her studies of the Bible, her Wyoming roots and work as superintendent.

Barlow, the most conversational in tone, leaned on his work in the Legislature, spoke of his faith in personal terms as a matter of daily living, and brought an edge of pragmatism to the highly idealistic debate.

A rare policy difference between the three candidates surfaced when Winters asked a question about whether abortion ends a human life, and whether the candidates would support any exemptions to an abortion ban.

All three candidates agreed that abortion ends a life. Degenfelder and Bien said they wouldn’t accept any exceptions.

“I can’t accept any exception when it comes to life,” said Degenfelder, adding that a Jan. 6 decision by the Wyoming Supreme Court - proclaiming that abortion is a health care right - “has gotten it wrong.”

Bien said, “I unequivocally support zero, no exceptions, all the way across the board.”

When serving in Iraq, said Bien, a 6-year-old child had been shot in the head. He and his fellow service members were trying to get the kid to Baghdad in the middle of the night, but he bled out, said Bien. He said he was pro-life before that, but, reflecting on how dependent even 6-year-olds are on their parents, he said, “something about that made me absolutely resolute.”

Barlow said in his heart, he would not want exceptions to an abortion ban- except possibly an exception to spare the life of a mother in a medical emergency. But he warned that the Legislature gets messy when crafting laws.

“I believe in life and I voted multiple times for life in the Wyoming Legislature,” he said.

Some of the many abortion bans and restrictions Wyoming has tried to pass since 2022 contained exemptions, like abortion allowances for women who’ve suffered rape or whose unborn children are a product of incest.

That’s because the Legislature is a collaboration between numerous people, Barlow said.

“Because in the legislative process, you actually have to bring people on board. You actually have to advance policy,” said Barlow.

The governor’s role on abortion policy is limited. He or she can sign, passively enact, or veto abortion legislation. But, more pivotal right now, he or she chooses the state Attorney General - who then defends Wyoming in abortion litigation from pro-choice groups.

The state has been facing - and losing - abortion lawsuits for about four years. It is taking a fresh start now under the leadership of Wyoming Attorney General Keith Kautz, who has said in court that his office seeks to bring evidence that a state ban on abortion is justified. It’s a high bar given the court’s broad protections of abortion, but technically not impossible under the legal definition of those protections. To overcome those protections, the government would have to show a compelling state interest for a ban, and that its ban is narrowly tailored to meet that interest. 

Deciding Who Leads The University Of Wyoming

Winters asked about how a governor should approach choosing trustees to lead the University of Wyoming.

Minor differences between candidates emerged here as well.

Degenfelder said UW should return to its rightful mission of being a land-grant university and feeding the Wyoming economy and job demands in useful and meaningful ways, rather than educating people for “women’s studies” and “careers that don’t exist.”

It’s time to find efficiencies in the university’s workings as well, she indicated.

She talked of her work to help rid the institution of diversity equity and inclusion (DEI) practices, and her own time at UW and as a member of the College Republicans.

Barlow said people ask him the UW trustee question a lot while he’s on the road.

In choosing trustees he’d emphasize finding people of character, he said.

“People who actually have a heart, and an ear for Wyoming. Who will listen to the interests and needs of… Wyoming’s people,” he continued. “And who abide by the constitution” and work well with other people.

UW is so “foundational,” he added, the Wyoming Constitution carves out its existence.

Community colleges, the K-12 school system, and industries all work in conjunction with UW as well, he said.

“UW may be a culmination for many folks,” said Barlow. “But there are many other opportunities” outside of UW as well.

Bien said he’d like to see UW trustees face election, rather than the governor’s appointment process - but that that would require a change to the state Constitution.

He said he graduated from UW’s college of engineering in 1991.

“Since then, things have changed a lot, and I have not been pleased,” he said. Like Degenfelder, he expressed dislike toward the more modern-social-movement degrees available and urged UW to “get back to our roots.”

He’d appoint people who understand Wyoming’s job needs, show leadership, and “understand what this state is all about,” said Bien, adding that they should also be people of sound moral judgment.

He said he’d like to strive for UW to be a top institution in the nation.

Winters asked a question about a decision that falls uniquely under the purview of the Wyoming governor: whether Wyoming’s state librarian should be in league with the American Library Association.

The Montana State Library cut ties in 2023 with the American Library Association over the ALA president of the time self-identifying as a Marxist.  

The group has also garnered controversy for touting and defending sexually explicit books that are marketed toward kids and youth.

Montana was the first state to break from the 147-year-old organization.  

Unlike Montana, Wyoming doesn’t have a state library board, rather, a state library director under the governor’s direction.

“My hat’s off to Montana,” said Bien at the Tuesday event. “We stop funding anything that promotes any type of hypersexualization.”

Degenfelder said that by taking ALA book suggestions in libraries and schools, Wyoming has let an organization that had been led by a Marxist determine material in them, and that that system is “broken.”

She agreed with Bien that the state shouldn’t pay dues to that group, and said state leaders should take the issue further, by equipping school boards with policy guidance, and letting parents know what problematic materials are in the libraries now.

Though the Legislature determines the state’s budget, the governor starts that process by proposing the budget, and he also can line-item veto certain provisions in the final budget.

“And then… there’s that red pen that says, nope, we’re not doing this,” he said. Certainly, he added, the governor can direct one person under his purview to do something or not do it. But the budget is a bigger tool, and “you hold (agencies) accountable to it.”

He also emphasized the need for parents’ to be involved in their children’s library access, and said he’d encourage that as governor.
