They have been dubbed by historians as the Arapaho Five, warriors who found themselves fighting against the cavalry in the Battle of the Little Bighorn 150 years ago this week. In the spring of 1876, these young bucks, as they called themselves, snuck off from the fort where their band was camping and became part of history.

In 1919, Tim McCoy, actor and adopted member of the Arapaho tribe, was sitting in a powwow with several Arapaho friends on the Wind River Indian Reservation along the Little Wind River. 

He later related the story to Darryl Ponicsan in a June 1977 article for the American Heritage magazine,

“They started telling me that Old Water Man was in that fight,” McCoy said. “I sort of scoffed at it because every Indian and his brother was in that fight. Practically all of them killed Custer.”

However, when McCoy began asking Water Man questions, the old Arapaho answered them all accurately. Determined to have the old men tell the stories themselves, McCoy arranged for separate interviews with Water Man and Left Hand in nearby Riverton by 1920. 

The other three warriors had already gone to the “great mystery” according to Left Hand and 

. However,  Sage, was still living near St. Stephens under the name of Sherman Sage. Only remnants of Sage's own story were ever recorded.

The two warriors McCoy knew about agreed their stories needed told.

“I had lived 22 snows at the time of the great battle on the Little Bighorn River,” 

told McCoy. “Soon Left Hand and I must go to the long sleep, and no one will be alive to tell the story, so I will tell you, whom the Arapahoes call their Soldier-Chief, everything just as I saw it, and nothing that is not the truth.”

Left Hand began his story by stating that he was part Blackfeet and part Cheyenne but had always lived among the Arapaho. He was born in the Powder River Country and, in 1876, was camped with the Arapaho at Fort Robinson, Nebraska, drawing rations, when he left with a war party to fight the Shoshones.

“When we were young men, it was the custom of the young Indian to go on small war parties looking for Shoshones or other unfriendly tribes,” Water Man explained. “If our medicine was good, we sometimes returned to camp with a scalp or a number of ponies.” 

The young bucks rode north into the buffalo country and, near the Little Bighorn River just south of what is now Crow Agency, Montana, met a small party of Sioux.

“They told us that the Sioux were going to have a sundance and said that we should come along with them to the Sioux village and have a good time,” Water Man said. “Afterward I learned that these Sioux thought we were scouts for the white soldiers.”

Unaware that they were being tricked, the five Arapaho rode with the Sioux. As they came near the village, a great many Sioux came out of the camp.

“They took all our guns away, and made us prisoners, saying that we were scouts of the white man, and that they were going to kill us,” Water Man said.

Young Two Moon, nephew of Cheyenne Chief Two Moon, said all the Sioux believed they were scouts from a camp of soldiers. He verified the Arapahos' claim of being held prisoner in a 1908 interview with George Bird Grinnell.

“Two men took their part — Black Wolf and Last Bull,” Young Two Moon said. “They said the people should wait and not act hastily.”

The Arapaho were taken into Two Moon’s lodge. The Sioux threatened to kill the five all night.

“In the morning, Two Moon, Chief of the Cheyenne, learned we were Arapahoes, so he went to the Sioux Chiefs and made them give us back our guns and set us free,” Water Man said.

The Arapaho were given back their guns but not allowed to leave camp. The young men saw the sun rise two times and the village grew to thousands of warriors, the most any had ever seen in one place.

It was on the third day, June 25, 1876, that the battle began.

All the Arapaho men had readied themselves for the battle. Water Man said he was dressed in beaded leggings, breechclout, a white shirt and a large war bonnet. Left Hand was dressed in a shirt and breechclout, and his medicine was a piece of buffalo hide made into a cross with two feathers in it, which he wore in his hair.

“My face was painted yellow and red and, around my neck, tied in a deer-skin medicine bag, was a certain root, which was my medicine,” Water Man said. “I still have that same medicine,”

Left Hand said the first attack, led by Major Marcus Reno, was at the south end of the village when the sun was at the position of about 9 a.m.

“The soldiers fired a few shots, but when we rushed toward them, they became frightened and started back across the river,” Left Hand said. “Many of them lost their horses and had to swim across."

He described how the soldiers climbed on a high ridge and built a barricade.

“There were many soldiers killed there,” Left Hand said. “The Sioux were all around them.”

When the sun was straight up, about noon, Left Hand heard shooting at the lower end of the village and knew it must be more soldiers.

“I went down through the village and crossed the river with a large party of Sioux and Cheyennes,” Left Hand said. “We Arapahoes had all gotten separated during the first fight.”

 had joined a group of warriors at the lower end of the village and fought off troops who were trying to cross the river and attack the camp. During the earlier part of the fight, Waterman was in a small gulch below the hill where the soldiers were stationed. He later moved up the hill and closed in on the enemy.

“There was a great deal of noise and confusion,” Water Man said. “The air was heavy with powder smoke, and the Indians were all yelling.”

Water Man said Crazy Horse, the Sioux Chief, was the bravest man he had ever seen.

“Crazy Horse rode closest to the soldiers, yelling to his warriors,” he said. “All the soldiers were shooting at him, but he was never hit.”

Water Man said he only knew of one soldier he personally killed. It was near the end of the fight when they rushed to the top of the hill and finished all that were still alive.

“I killed him with my gun, but did not scalp him because the Arapahoes do not scalp a man with short hair, only long hair,” Water Man said.

Left Hand, who counted 13 coup during the battle, saw an Indian on foot who was wounded in the leg.

“Thinking he was one of the Crow or Arikara scouts with the soldiers, I rode at him, striking at him with a long lance which I carried,” Left Hand said. “The head of the lance was sharpened like an arrow. It struck him in the chest and went clear through him.”

The Indian fell over a pile of dead soldiers. Afterward. Left Hand discovered the man he killed was actually Sioux.

“The Sioux were going to kill me because I had killed their friend,” Left Hand said. “One Sioux tried to take my horse away from me, but I would not give him up.

“Everyone was excited. The hills were swarming with Indians, all yelling and shooting.”

Left Hand said that as he came up on the ridge, one soldier, who was on the ground, handed him his gun.

“I took the gun and did not kill him, but some Sioux who were behind me killed him,” Left Hand said. “I went back and took his belt, which had many cartridges in it.”

McCoy said the soldier was wounded and handed Left Hand his gun to surrender.

“They didn’t understand. You don’t surrender to an Indian 

 you either fight or you die,” McCoy said. “Left Hand took the gun, but he couldn’t use it because the shell jammed in the chamber.”

“He was dressed in buckskin and was standing up and had pistols in his hands shooting into the Indians,” Left Hand said. “I did not see him again until it was all over. I walked around and saw him lying there. He was dead.”

Water Man also reported that Custer was wearing buckskin. But by the time he saw him, Custer was on his hands and knees.

“He had been shot through the side and there was blood coming from his mouth,” Water Man said. “He seemed to be watching the Indians moving around him.”

Water Man described how four soldiers were sitting up around Custer, but they were all badly wounded. The next time he saw Custer, he was dead.

After the squaws, as the old men called the women of the tribe, had cleared the battlefield, the Arapahoes knew they had to escape. The Sioux were angry at Left Hand for killing one of their own and were waiting to take revenge.

The next morning, the Sioux broke camp and started for the mountains. They had heard some soldiers were coming up the river, and the Indians were scared.

“That night after they had made camp and it was dark, we four Arapahoes crawled out to the pony herd and, each mounting a pony, slipped away,” Left Hand said. “We travelled as fast as we could back to Fort Robinson where the Arapahoes were.”

At the time they shared their stories with McCoy, the old men were living on the reservation and life was much different.

“The buffalo are all gone, and the Indians who once roamed these plains and were happy are now held on reservations as wards of the government,” Water Man said. “We are old men now, and soon we too must pass over to the great mystery. That is why I have told you this story.”

Left Hand also commented on how different times were during his 1920 interview.

“The white men used to trade us guns for buffalo robes, but now it is all changed,” Left Hand said. “The buffalo are all gone, the antelope are gone, and now we old men can only sit by the fire, sing our war songs and dream of the past.”

Imagine you hire a manager to run your business. You hand them a detailed, written rulebook. But instead of following it, the manager decides they know what is best for your company. They start crossing out your rules, writing in their own, and running the business exactly how they see fit.

How long would that manager keep their job? You would fire them immediately.

Yet, as Wyoming voters, we tolerate this exact behavior from our state judiciary. We do our civic duty. We go to the ballot box. We elect representatives to go to Cheyenne and pass conservative laws that reflect our values—whether it is protecting life, securing our elections, or defending our constitutional rights.

But increasingly, after the votes are counted and the laws are passed, those laws are quietly erased. Not by the voters, and not by the legislature. They are vetoed by unelected lawyers wearing black robes.

How do they pull this off? They do it through a legal magic trick called the "balancing test."

Instead of reading the plain, black-and-white text of the Wyoming Constitution and our state statutes, courts import judge-made standards—terms like "strict scrutiny," "balance of equities," or "minimal burdens." These phrases appear nowhere in our laws. They are subjective scales, invented by judges over decades, that allow courts to weigh a democratically enacted law against their own personal sense of what is "reasonable."

When a judge decides a law fails their personal balancing test, they strike it down. The result is a total subversion of the separation of powers. The courts are no longer acting as neutral umpires calling balls and strikes; they are stealing the legislative pen and acting as politicians.

Our State Constitution was supposed to have a safety valve for this: the judicial retention election. But let’s be honest with ourselves. When you reach the bottom of your ballot and see the question, “Shall Judge X be retained in office?”, you are flying completely blind.

Unless a judge is caught in a scandalous headline, their actual courtroom record is a black box. The primary group telling you how to vote is the Wyoming State Bar, which releases an insider "Advisory Poll" rating judges on vague traits like "temperament." It is a rigged game where lawyers rate the very judges they have to appease the next morning. It tells the public absolutely nothing about whether a judge is actually following the law or rewriting it.

Because voters have no real information, they universally check "Yes" by default. A system designed to be a democratic check and balance has devolved into a rubber stamp for lifetime appointments.

We cannot fix a rigged game simply by hoping for better judges. We have to rewrite the rules of the game so that judicial activism becomes a literal violation of the law.

Transparency is the first step. We must strip the State Bar of its monopoly on judicial evaluations. Wyoming needs an independent, citizen-led Judicial Performance Commission that publishes a real public dashboard before every election. Voters need objective metrics: a judge’s reversal rate, their docket delays, and plain-English summaries of when they have used judge-made tests to strike down the legislature's work.

But transparency is not enough. We must permanently reclaim the voters' constitutional power by binding the judiciary to the plain text.

We cannot achieve this with a standard statute, because activist courts will simply strike it down. We need the Wyoming Legislature to put an "Interpretive Mandate" Constitutional Amendment on the next ballot. This amendment would serve as the ultimate Contract with Wyoming, completely changing the rules of engagement for the bench.

First, it would enact a strict Textualist Oath. Before anyone is handed a gavel, they must publicly swear to construe the Constitution and state laws strictly according to their plain, original text. They must explicitly vow not to substitute their own policy judgments or imported balancing tests for the written law. This acts as a foolproof litmus test: if a nominee refuses to swear to read the law as written, they disqualify themselves.

Second, the amendment must arm the legislature with a usable weapon to enforce that oath. Currently, the legislature can impeach a judge for "malfeasance," but the term is so vague that lawmakers are terrified to use it for fear of looking political.

This amendment would constitutionally define "malfeasance." It would explicitly state that if a judge uses extra-textual balancing tests like "strict scrutiny" to bypass the law, they have broken their oath and committed constitutional malfeasance. This takes the politics out of impeachment. The legislature wouldn't be firing a judge over a political disagreement; they would be firing them for a breach of contract.

Getting this amendment on the ballot requires a two-thirds vote in Cheyenne. To conservative lawmakers frustrated by courts vetoing their hard work: this is your shield. This amendment takes your constitutional power back.

To the voters: this is the easiest ballot question you will ever face. It simply asks, “Should Wyoming judges be legally required to follow the law exactly as it is written?”

The legal establishment will fight this tooth and nail. They will claim it handcuffs the courts. But they are wrong. It handcuffs the activists. It returns the power where it belongs: to the written law, to the legislature, and ultimately, to you.

As of Monday, 35 Wyoming political candidates have sworn to love their enemies.

 after the public killing of conservative icon Charlie Kirk, and has since been working to restore the servant spirit and civility to the public arena in Wyoming.

The Tuesday after the May 14-29 filing period ended for political candidates, the group sent each candidate a pledge, group incorporator Matt Micheli told Cowboy State Daily.

“I will love my enemies, not just my friends. I will stand faithfully upon my convictions without giving into cruelty,” the pledge says. “I will call out wrongdoing without canceling people. 

"I will refuse to let the letters on someone’s hat or the hashtags in their bio mean more to me than the Gospel. I will not be swept up in the outrage cycle, but will instead step out of the chaos and boldly examine my own actions.”

The signers also commit to “bring the peace of Christ back into the public square — to show a divided world what it truly looks like to follow Him, not as a culture warrior but as a Kingdom person.”

The pledge invokes the group’s founding verse, Matthew 5:9: “Blessed are the peacemakers, for they will be called children of God.”

Two of the three GOP candidates for governor had signed the document as of Monday: Sen. Eric Barlow and Superintendent of Public Instruction Megan Degenfelder.

So too had three of the 10 Republican U.S. House candidates: Senate President Bo Biteman, former Superintendent of Public Instruction Jillian Balow, and Casper-based veteran Kevin Christensen. U.S. Senate candidate Jimmy Skovgard is also among the signers.

In the governor’s race, Barlow told Cowboy State Daily he doesn’t normally answer candidate questionnaires, but this one was “quite simple” and in line with the promise he made last year to run a clean campaign anyway.

“And whether we agree on issues or don’t, we can still be respectful and honoring of them as, you know, fellow human beings,” Barlow said.

wer of Christ and certainly agree that politics has become increasingly unchristian."

"People of faith can and should do better following Christ’s teachings as we engage in debates about policy and Wyoming’s future," she said. "We can do this without compromising on our convictions. I will always take an unequivocal stand on issues that are black and white for me - like protecting the Second Amendment, defending the sanctity of life, reducing taxes, and promoting Wyoming’s legacy industries."

She said she completes other questionnaires from voter groups, the media and industry associations "whenever possible" and sees them as a way to be transparent.

Cowboy State Daily this pledge could be effective in Wyoming, and that he wants to help the group’s cause.

Another former lawmaker, Fred Harrison, was less optimistic about the pledge’s ability to curb vitriol in the state’s political arena. But he said each person should take the effort seriously.

In 2020, the group Wyoming Gun Owners launched a pledge-style survey to candidates and derided the political hopefuls who didn’t sign it with phrases 

, “(it’s) a very dangerous situation for gun owners,” or “we all know what that means.”

More recently, the Wyoming Republican Party and its county subgroups launched a candidate pledge based on the state party platform. 

Some candidates have pointed to inconsistencies in the platform wording and called the

Micheli said the Peacemakers pledge isn’t meant to be used as ammunition, because its wording discourages that.

“The goal of this is kind of the opposite of all these other pledges you see out there,” he said. “The other pledges are kind of putting people into tribes and trying to figure out what tribe you’re in.”

Micheli said this pledge, however, tells each candidate to “look inward” and improve instead of “hammering anybody else over the head with it.”

Peterson, who served in the Wyoming Senate from 2005 to 2018, lauded the effort.

Peterson had voiced similar goals one week prior on a live video interview on Cowboy State Daily's Morning Show With Jake, 

Though the effort is “the light at the end of the tunnel” in what Peterson cast as a darkening, exhausting political arena, people will have to refocus on one another as fellow human beings to make it work, he said.

“If you love the person that’s opposed to either your way of life or philosophy or way of thinking,” he said, “and in your mind, your core belief is this is a brother, a sister, a person — and I don’t know what life experiences they’ve had, what brought them to the beliefs they have — it at least gives (one) the courtesy to be patient and listen.”

It takes effort to see the person through the issues. It’s also difficult to ratchet people down from the fiery realms to which public discourse has risen, said Peterson.

“It’s hard work to listen to somebody yelling and screaming at the top of their lungs, random thoughts and things to be argumentative … and say, ‘Oh, I can see you’re very passionate about your belief but you’re not making any sense,’” he said.

Rules of decorum in public arenas, the humility to apologize to one another where necessary, and applying mental rigor toward the actual issues are the way back to civility, Peterson added.

If people avoid dehumanizing and screaming at each other, their conversation will also get smarter, he said.

Harrison wasn’t as optimistic as Peterson, but called the pledge’s mission a worthy undertaking for each individual regardless of what society does.

“I’m not seeing a willingness on both sides of the aisle to discuss (differences),” he said. “I appreciate what they’re doing. I think it’s a wonderful idea.”

But, he added, “I’m not sure it’s always going to work, but that doesn’t mean anything. What did Mother Theresa say? We’re called to be faithful, not successful.”

He was a Democrat then. But, ardently pro-life and socially conservative, he parted ways with the party starting in about 1992 and is now Republican. He’s also grown more fiscally conservative, Harrison said.

Harrison now writes a regular column for Cowboy State Daily in which he often scrutinizes the current state of the judiciary and jurisprudence.

“People think my articles are pretty sharp,” he said with a chuckle. Yet on May 9, he penned a 

 against resorting to violence or violent sentiments against judges, saying that nullifies good arguments on the issues.

If people wish to apply the peacemaker group’s pledge, it will take honest discussion, he said. People also have to start taking the high road and stop de-humanizing each other, he added.

Micheli told Cowboy State Daily the group didn’t give candidates a deadline to sign the pledge. So this list isn’t final. As of Monday, the 35 signers spanned the governor’s, congressional, state legislative, and county commission races. They are:

The Wyoming group that launched a civility movement after the killing of Charlie Kirk has gotten 35 candidates to sign a peacemaker pledge to love their enemies. That includes gubernatorial candidates Eric Barlow and Megan Degenfelder.
